As an Employer you are not required by law to have a Staff Handbook, but you must have certain procedures and policies documented. We advise that these are best contained in a Staff Handbook.
Whilst the Contract of Employment sets out the employees’ rights and duties, as the employer you also need a set of policies that, for example, comply with the ACAS Code on grievance and disciplinary procedures. This can be of great importance as failure to follow the ACAS Code in a grievance or disciplinary matter could result in a 25% uplift in a compensation award at an Employment Tribunal.
At Rowlinsons we can advise and draft a Staff Handbook or individual policies and procedures that are appropriate to your company and its workforce. Generally these include:
- Equal opportunities policy. This is very important as a tribunal will often look at the policy when considering a discrimination claim)
- Maternity, paternity and adoption policies;
- Whistleblowing policy;
- Bribery Act policy;
- Parental leave policy;
- Compassionate and bereavement leave;
- Flexible working.
If you already have a Staff Handbook, then we would recommend that this is regularly reviewed so as ensure that it is up to date and ultimately compliant.
